A qualifying organization for L-1 purposes refers to a U.S. or foreign firm, corporation, or other legal entity that:

• Meets exactly one of the qualifying relationships specified in the definitions of parent, branch, affiliate, or subsidiary;
• Is or will be conducting business as an employer in the United States and at least one other country, either directly or through a parent, branch, affiliate, or subsidiary, for the duration of the L-1 beneficiary’s stay in the United States as an intracompany transferee; and
• Otherwise satisfies the statutory definition of a nonimmigrant intracompany transferee.

The EB1C visa is an excellent option for managers and executives seeking to transfer from a foreign company to a related U.S. company. With an EB1C visa, a foreign worker can obtain a green card for themselves, their spouse, and their unmarried children under 21 years of age. To qualify for an EB1C visa, the following five main requirements must be met:

1. There must be a qualifying relationship between the foreign company and the U.S. company.
2. The visa beneficiary must have worked for the foreign employer for at least one continuous year within the three years preceding the filing of the EB1C visa petition.
3. The visa beneficiary must have been employed by the foreign company in a managerial or executive capacity.
4. The visa beneficiary must have a full-time job offer to work for the U.S. company in a managerial or executive capacity.
5. The U.S. company must have been conducting business for at least one year prior to filing the EB1C petition.
